Freedom Fraud: Trans activists are lying to Granite Staters about ‘Gender Identity’ bill

The FREEDOM FRAUD of House Bill 1319

By Kimberly Morin

Tomorrow, the New Hampshire House of Representatives is scheduled to vote on House Bill 478 (HB 478), AN ACT prohibiting discrimination based on gender identity, also coined the ‘TransBillNH’ online. Yesterday Political Buzz posted an article about current discrimination laws already providing protections for transgenders to sue based on discrimination at the federal level. There are many side effects and issues with the legislation but it was also discovered yesterday that everyone, including transgenders, are already covered under the same discrimination laws as all Granite Staters.

You may not be aware but New Hampshire has a Human Rights Commission. This commission is responsible for “eliminating discrimination in employment, public accommodations and the sale or rental of housing or commercial property, because of age, sex, sexual orientation, race, creed, color, marital status, familial status, physical or mental disability or national origin.”  The commission was set up under RSA 354-A and has been working to help any Granite Stater who has been discriminated against, including transgenders.

Representative Jess Edwards spoke with the commission’s executive director Joni Esperian who explained how the current laws already help transgender people who feel discriminated against:

The New Hampshire Constitution serves to protect the human rights of all the people under Articles I & II. To enforce those rights, the New Hampshire Commission for Human Rights has had the authority for 30 years to hear gender identity cases .

Currently the Commission has one gender identity case in the backlog of 338 cases as of the end of February. This is data provided to one of the Finance committees as they request additional investigators.

In the past decade, there have been four other gender identity cases which got resolved before a Commissioner needed to issue a probable cause ruling.

In short, there has been Constitutional and legal structure to enforce gender identity non-discrimination in New Hampshire for 30 years. That authority arose from the judicial branch in the decision Jane Doe v. Electro – Craft Corporation.

In the past decade, there have been four other gender identity cases which got resolved before a Commissioner needed to issue a probable cause ruling.

Esperian said she thinks the Constitutional arguments for protecting transgender rights is sound and that the Commission benefits now from precedent.

Trans activists know this. There has not been some outcry from people in New Hampshire to end perceived discrimination that isn’t happening. The people pushing this are from out of state and are intentionally pushing specific new laws that will infringe upon the freedoms of others. They want everyone to conform to their ideas rather than have everyone experience the same protections, as individuals, as they already do today.

It’s unclear if transgenders are just pawns being used by the left or if they are willing participants to push an extreme left wing agenda. But that’s exactly what this ‘Gender Identity’ bill is, an agenda. That’s why they are ignoring existing anti-discrimination laws that cover everyone when it comes to discrimination and pushing a special carve out for gender identities.

Infringe upon freedoms

What exactly is on the agenda? To infringe upon Freedom of Speech and Freedom of Religion rights along with forcing everyone else to conform to their ideology and way of thinking. The U.S. Commission on Civil Rights under the Obama Administration specifically targeted religion exemptions that are protected by the 1st Amendment:

Overly broad religious exemptions unduly burden nondiscrimination laws and policies. Federal and state courts, lawmakers, and policy-makers at every level must tailor religious exceptions to civil liberties and civil rights protections as narrowly as applicable law requires.

What about the civil rights of those who practice religion? The left has been trampling all over them for years now. David French wrote about this and explains it further:

In the Commission’s eyes, there is no true accommodation of religion, because religion is merely an “excuse” for discrimination. Thus, there is no value in attempting to build a society where religious believers can live with integrity and — yes — “dignity” alongside sexual revolutionaries. But accommodation and mutual respect have never been the revolutionaries’ aim. Their goal is clear and explicit: to equate sincere religious objections to sexual immorality with the invidious discrimination of Jim Crow, and then to banish believers to the same margins of society currently occupied by white supremacists.

Freedom of Religion is actually a protected right in the Bill of Rights, it’s not some right made up by the government that was given to people as the gender identity bill does. These people demand acceptance as individuals yet are unaccepting of others who aren’t like them or don’t believe the same as them; therefore, they must infringe upon the rights of those who think differently.

When it comes to Freedom of Speech they are doing the same exact thing and using unnecessary “carve out” laws such as House Bill 478 to achieve it.  These groups are well-funded super PACs and lobbyists from other states who are intentionally lying about current laws in New Hampshire to further their agenda. They intentionally mislead legislators by naming their multi-million dollar rights infringement “Freedom for All Americans.” From the New York Times:

The new group is a partnership of the American Unity Fund, a super PAC created by the hedge fund executive Paul Singer, as well as the Gill Foundation and the Gill Action Fund. Tim Gill, a Colorado-based Democratic activist and philanthropist, has been a major financial backer of same-sex marriage efforts.

The group will focus on making existing anti-discrimination laws in states like New Hampshire more comprehensive than they are now to, for instance, give explicit protection for transgendered people.

As previously stated above, transgendered people already have the same protections under current law that all other individuals in New Hampshire share. That is exactly how it is supposed to work. Of course, that’s not why these left wing extremists and anti-freedom out-of-state activists want special laws. From Stella Morabito at The Federalist:

Laws intended to change how individuals think—about anything—require enforced silencing. If the “Freedom for All Americans” meme is about freedom (which it’s not), then it’s only about negative freedom. That is, freedom from “discrimination.”  Freedom from “hate.”  Which basically gives carte blanche to those holding power (ultimately, the state) to define and cherry pick whatever “discrimination” and “hate” may mean before granting whatever due process is left over for the accused.

So laws of this sort, hiding under the fig leaf of “anti-discrimination,” will give the state the power to police speech and behaviors.

Free expression becomes “hate speech” if one doesn’t fall into line with the directives of the transgender lobby or its pronoun protocol. Freedom of religion takes a direct hit any way you look at it.

Republicans should always be wary of outside organizations of the left wing variety trying to claim they know what freedom is in New Hampshire. Liberty Republicans and Libertarians who were conned are even worse because they should know better. A majority of Democrats are always about infringing upon the Bill of Rights. They simply hate freedom and want the government to control all aspects of every individual’s life. This is how they always behave.

House Bill 478 should be burned at the stake; killed and buried never to be seen again. This bill is one of the most egregious bills to actually hit New Hampshire in years. Not one person who actually believes in freedom should support this bill, including the target “identity-politics victims,” transgenders. Once again, as with other legislation, out-of-state money from millionaires and billionaires is being spent to infringe upon the freedoms and liberties of unknowing Granite Staters at the behest of legislators who should know better.
